Kenya High Court rules Iranian suspects will remain in custody

The Kenya High Court ruled on Thursday (August 16th) that two Iranian terror suspects who were released on bail last month will remain in police custody until their case is resolved, Kenya's Star reported.

The two suspects, Ahmed Mohamud and Sayed Mausud, have been accused of possessing 15 kilograms of the powerful explosive RDX in preparation for a terrorist attack on Kenyans. Justice Lydia Achode said the arrests came after credible reports suggested that 100 kilograms of RDX had been shipped from Iran to Kenya, 85 kilograms of which has not been recovered.

The High Court reversed a lower court's decision to release the suspects on bail of 2 million shillings ($23,800) each last month.

Achode said Kenya has not signed an extradition treaty with Iran and it is not clear if the suspects would return to Kenya for prosecution should they depart for their home country.

She dismissed their claims that they needed to be released to seek medical treatment and deemed the care provided in the prison adequate.

If convicted, Mohamud and Mausud face the possibility of life imprisonment.
